Car Accidents: Deciding When to File a Lawsuit

A couple of weeks ago I wrote about how the Denver auto accident attorneys at The Law Offices of Dianne Sawaya work to negotiate a settlement in your car accident case, and the shenanigans insurance companies sometimes use to keep your settlement low so they don't have to pay out a big claim. This week I want to talk about what happens if the insurer refuses to negotiate a reasonable settlement.


Because we've negotiated literally thousands of claims, we get a pretty good sense of when an insurance company has offered the most (or close to the most) that they're going to offer. If it's a fair and reasonable amount for your injuries and suffering, we'll suggest you accept the offer. If not, with our advice and assistance you have a decision to make on whether or not to file a lawsuit.

A trial is a little like standing at the craps table in Las Vegas. Do you roll the dice? You have your money in front of you - maybe not as much as you'd like, but probably more than the casino (or insurance company, in your case) wants you to have. Both sides know that an unpredictable jury could give you a big award - or nothing at all.  No one wants to take a case all the way to trial; it's expensive and time-consuming. Sometimes lawsuits are necessary, but it's better left as a last option. If it comes to that point, we can help you make your decision.
