Dealing With a Hit-and-Run Driver

I remember coming out of the mall a couple of years ago to find my rear fender crumpled. Someone had obviously swung wide pulling into the parking spot next to me and creased my car. There was no note telling who had done it; I'm sure it just slipped their mind.


That's technically a hit-and-run accident, but often as not a Denver hit-and-run car accident occurs out on the streets and many times someone is injured. The driver has fled, no one got the license plate and it may seem that the perpetrator has gotten away with it.

But what about you? You've been crashed into and you're hurt. Now what?

If the hit-and-run driver is never identified, it isn't possible to recover damages from that person. In addition, a large number of hit-and-run drivers leave the scene because they're uninsured, so identifying them may not make any difference. Or possibly the hit-and-run driver was drunk and was trying to avoid being arrested.

In cases like this, Colorado hit-and-run accident law treats the other driver as if they were an uninsured driver. That's why it's important that your auto insurance policy include UM/UIM coverage - uninsured motorist coverage will protect you. If a hit-and-run driver injures you, you may still be able to recover for your medical bills, lost wages, and pain and suffering by bringing a claim under your own insurance policy's uninsured motorist provision.
