Facebook May Not Be Your Friend

It’s a new social-media world out there, and The Law Offices of Dianne Sawaya is seeing a new trend among insurance companies. In their quest to avoid paying claims, insurance companies are using sites like Facebook, Twitter and YouTube to look for what they can claim is fraud and then use to deny a claim.

Insurers may assign an insurance company investigator to check out a claimant, and the investigator often uses social media as one way of doing research. Some investigators go so far as to “friend” clients, opening up that client’s personal information to the insurance company. Social media sites can be filled with information insurance companies can use against you. One investigator recently called social media “an amazing tool” that can provide a mother lode of data that he can use to dispute personal injury,  accident and workers’ compensation claims.

 

We regularly suggest to our Denver personal injury clients that they think about not using social media such as Facebook and Twitter during the course of their case – or at the very least, that they be VERY careful of what they post. Don’t post anything that you wouldn’t want the world to see or read, particularly anything about your case. Remember: Big Insurance is watching, and what you post can and will be used against you.
