What If the Other Driver is Uninsured?

Colorado law requires every driver in the state to have a minimum amount of auto insurance - $25,000 to cover damage and injuries to another individual and their vehicle, and a total of $50,000 to cover damage and injuries to all other vehicles and persons involved in the car accident.

That's pretty straightforward. The problem is, about a third of the drivers on Colorado roads don't have insurance. And then there's who knows how many more drivers who have only the minimum amount of insurance - which is usually not enough. So what do you do if you are in a Denver auto accident caused by one of these drivers?

If you have uninsured/underinsured motorist coverage on your auto policy, it may pay for your injuries. It's insurance provided to pay you if you've been in an accident with someone who either has no insurance or doesn't have enough insurance to cover all the injuries and damages they cause.

Colorado law requires insurance companies to offer at least $25,000 of uninsured/underinsured coverage as part of any auto insurance policy. You can refuse the coverage by signing a form. Don't do it. You may save a little but wind up losing a lot in the end. Always have uninsured/underinsured motorist coverage on your policy. UI/UIM coverage is crucial, and you shouldn't be without it.

If you've had an auto accident and the other driver is uninsured, the laws governing this situation are complex and you need a good attorney. Give me a call at (303) 758-4777 or email me at DLS@dlslawfirm.com. We'll work with you to create a plan of action to take care of you.
