What do we mean by "serious injury"

There’s no special definition of “serious personal injury,” and everyone likely considers their injury to be serious. But when evaluating a case in terms of negotiating with an insurance company or preparing for trial, there are certain hallmarks of a serious injury.




Generally, serious injuries have long term or permanent consequences. They involve physical, psychological or economic disability or a significant impact on a person’s life. Broken bones, herniated discs, significant burns and injuries that require surgery would fall into the category of serious. Injuries to the brain or spinal cord are almost always considered serious. Without doubt, the loss of a limb or an essential organ is a serious injury.

Costs and expenses can be a good indicator of the seriousness of an injury. A person who has significant medical and surgery bills, lost wages and similar expenses almost certainly is suffering from a serious injury. Future or continuing medical expenses, additional lost wages (or even loss of a job or complete disability) or other special costs such as rehabilitation or in-home care, also indicate that the injury is probably serious.
